(Page last updated Dec01, 2025) Leo was the son of Thomas and Marthia [Harris] White. The Grandson of Thomas and Marthia Harris White, also of Maud Bowie Co TX. His great grandfather was Benjamin and Polly NIx White. They arrived in Bowie Co 1846, with Leo's Gr Gr grandfather, Elias & Anne Gibbs White, from Union Co SC. Elias brought others with his 13 wagon train, Harlan's, Bobo's and Nix's surnames that his family, had married into, in SC. ***PHOTO TO LEFT - Leo & Sally - late 1950's. White The State of Texas County of Bowie Know all men by These Persents: That I, L. L. White, of the County of Bowie, State of Texas, being of sound and disposing mind and memory, do make and publish this, my Last Will and Testament, hereby revoking all other wills and testaments by me at any time heretofore made. I am the husband of Sallie D. White. Of the marriage of Sallie D. White and myself, seven children were born, to-wit: Frances Laurie Townsend, Charles Richard White, Mary Eugenia Dittrich, Edward Leo White, Lola Inez Merritt, Nancy Joan Green and Lewis Gerald White. No other child or children, except as named above, were born to me at the date of execution of this will and no child or children were adopted by me at the date of execution of this will. I. I desire and direct that my body be given a decent burial suitable to my cirumstances and station in life, and that the ex- penses thereof and all of my just and lawful debts be paid out of my estate by my Independant Executrix or Independant Excecutor or Co-Indenpendant Executors, as the case may be, hereinafter named and appointed as soon after my death as in practicable. II. A. I give, bequeath and devise to my wife, Sallie D. White, All of my estate, of whatsoever character and wheresoever situated, to be hers in fee simple. B. In the event that my wife, Sallie D. White, should pre- decease me or should we die simultaneously, or in the same common accident or calamity, or under circumstances causing doubt as to which of us survivied the other, then, and in the event of the occur- rence of any one or more of such events, I give, devise and bequeath all of the property, both real and personal, of which I may die seized and possessed to my children, Frances Laurie Townsend, Charles Richard White, Mary Eugenia Dittrich, Edward Leo White, Lola Inez Merritt, Nancy Joan Green and Lewis Gerald White, in fee simple, forever, share and share alike, subject to, however, the right of first refusal hereinafter granted to two of my children, Nancy Joan Green and Lewis Gerald White, and the right to lease certain property hereinafter granted to my son, Lewis Gerald White. III. My Independent Exector, Independent Executric, or Co- Independent Executors, as the case may be, are hereby directed and authorized to lease the following described property to my son, Lewis Gerald White, for a period beginning on the date of the death of the survivor of myself or my wife, Sallie D. White, and ending five (5) years from date thereof, for the annual rental of $300.00 per year, which rental shall be payable in advance. The Property to be demised in described as follows, to-wit: Tract One: A part of the Alvin Owsley 538 acre tract in the A. G. Melton H. R. Survey, and more particularly described as follows: The South Half of Lot No. 3 in the division of the A. C. Owsley 538 acre tract. BEGINNING at the Southeast Corner of said Lot NO. 3, from which a red oak brs W 4 vrs, a ditto brs N 48 deg. East 5 vrs, marked X; THENCE North 470 vrs, a stake from which a red oak brs S 25 deg. Milton Headright Survey, Patent No. 258, Volumn 13, Abstract NO. 375, and being a portion of a 538 acre tract of said survey set apart to A. C. Owsley, in the subdivision of a portion of said survey. BEGINNING at a stake on the North boundary line of said survey, 775 vrs. East of the N. W. corner of said A. C. Owsley 538 acre tract, the N. E. corner of Lot No. 1, a red oak mkd X brs. S. 26 W. 1 1/2 vrs; THENCE South with the East boundary line of Lot No. 1 of said division 484 2/3 vrs. to a stake a red oak mkd. X brs 83 1/2 East 10 vrs. a black jack mkd. X brs. In the event of a contemplated bona fide sale of the pro- perty described in Paragraph III hereinabove by my children herein- above named, my children hereinabove named shall give to my son, Lewis Gerald White, a notice in writing of the considereation for and terms and conditions on which it is proposed that such sake shall be made, which notice shall be delivered by Union States Registered Mail, Return Receipt Requested, not less that fifteen (15) days prior to the date on which it is proposed that such contemplated sale shall be consumated and my son, Lewis Gerald White, shall have the option and privilege of purchasing the premises upon the same terms and con- ditions and for the same consideration as specified in such notice which option and privilege shall be exercised, if at all, by written notice of the exercise of such option and privilege delivered to my other children by United States Registered Mail, Return Receipt Re- quested, within ten (10) days of receipt by my son, Lewis Gerald White, of such notice of such proposed sale and on failure of my son, Lewis Gerald White, to exercise such option and privilege within such period of ten (10) days, the option and privilege hereby granted to my son, Lewis Gerald White, shall terminate and become null and void and thereafter my children shall be at liberty to sell and convey the premises at the consideration and on the terms and conditions specified in such notice of such contemplated sale. The privilege and right hereby conferred shall become void and of no force and effect upon the expiration of ten years from the date of death of the last to die of myself or my wife, Sallie D. White. V. In the event of a contemplated bona fide sale of that certain parcel of land conveyed to L. L. White by C. E. Warrington, et ux, by deed of record in Vol. III, Page 134, Deed Rcords of Bowie county, Texas, by my children hereinabove named, my children hereinabove named shall give to my daughter, Nancy Joan Green, a notice in writing of the consideration for and terms and conditions on which it is proposed that such sale be made, which notice shall be delivered by United States Registered Mail, Return Receipt Requested, not less that fif- teen (15) days prior to the date on which it is proposed that such comtemplated sale shall consumated and my daughter, Nancy Joan Green, shall have the option and privilege of purchasing the premises upon the same terms and conditions and for the same consideration as specified in such notice which option and privilege shall be exerecised, if at all, by written notice of the exercise of such option and pri- vilege delivered to my other children by United States Registered Mail, Return Receipt Requested, within ten (10) days of receipt by my daughter, Nancy Joan Green, of such notice of such proposed sale and on failure of my duaghter Nancy Joan Green, to exercise such option and privilege within such period of tne (10) days, the option and privilege hereby granted to my daughter, Nancy Joan Green, shall ter- minate and become null and void and thereafter my children shall be at liberty to sell and convey the premises at the consideration and on the terms and conditions specified in such notice of such contem- plated sale. The privilege and right hereby conferred shall become void and of no force and effect upon the expiration of ten (10) years from the date of death of the last to die of myself or my wife, Sallie D. White. VI. A. I appoint my wife, Sallie B. White, as Independent Exe- cutirx of this will and of my estate. If my said wife, Sallie D. White, should fail or cease to serve as Executrix, for any reason, then I appoint two (2) of my children, Lewis Gerald White and Nancy Joan Green, or the survivor of them, as co-Independent Executors or Independent Executrix or Independent Executor, as the case may be, of this will and of my estate. B. My Independent Executrixx or Independent Executor or Co- Independent Exeutors, as the case may be, shall receive no cmpen- sation for acting in his or her official capacity, and no Independent Executrix or Independent Executor or Co-Indepentent Executors, as the case may be, shall be required to furnish bond or any other security. C. Wheather or not my estate is indebted to any person, I give unto my said Independent Executrix or Independent Executor or Co-Indepentent Executors, as the case may be, from the date of grant- ing letters until my estate has been entirely distributed the same rights, powers, authority and privileges and discretion with refer- ence to the control, management and disposition of my estate that are given to trustees by the provisions of the Texas Trust Act (Article 7425 b V.A.C.S. Texas) in addition to all powers given to independent executors by law. D. I direct that no other action shall be had in the County Court in relation to the settlement of my estate that the pro- bating and recording of this my last Will and Testament and the return of an inventory, appraisement and list of claims of my estate.
